Any business processing personal data (collecting, recording, storing, using, etc) of EU residents are likely to be affected by the GDPR. The regulation comes into effect on May 25, 2018.

Introduction

These Terms of Use (“Terms”) are a legal agreement between you and WordPromise, a service from Dreamdax Technology Pvt. Ltd. (“Company,” “we,” “us,” “our”) that governs your access to and use of www.wordpromise.com (the “Site”). References to “you” and “your” mean any person or legal entity that accesses or uses the Service, including those who visit or make a purchase on the Site. Your access to and use of the Service is conditioned on your acceptance of these Terms and our Privacy Policy and any additional terms that may be provided or presented to you when you use the Service, which are incorporated into these Terms by this reference. By making a purchase through the Service, registering for an account, or otherwise accessing or using the Service, you agree to be bound by these Terms and our Privacy Policy. If you do not agree with these Terms or our Privacy Policy, you should not access or use the Service.

The following website maintenance contract and terms and conditions govern all use of the WordPromise website and all content, services and products available at or through the website (taken together, the Website). The Website is owned and operated by WordPromise. The Website is offered subject to your acceptance without modification of all of the terms and conditions contained herein and all other operating rules, policies (including, without limitation, WordPromise Privacy Policy) and procedures that may be published from time to time on this Site by WordPromise (collectively, the “Agreement”).

PLEASE READ THESE TERMS AND CONDITIONS OF USE (“Agreement”) CAREFULLY. BY USING THE SERVICES, YOU AGREE TO BE BOUND BY ALL OF THE TERMS AND CONDITIONS OF USE MENTIONED BELOW.
These Terms & Conditions of Use constitute a legally binding Agreement between you and WordPromise, having its office at Plot #94, Dwarka Sector 13, New Delhi 110078, India, regarding your use of the Services.
These Terms and Conditions of Use (“Terms,” including our Privacy Policy, Cookie Policy and all other policies on our Websites) define the terms and conditions under which you are allowed to use our services, and how we will treat your account with us.
By accessing or using any part of the web site, you agree to become bound by the terms and conditions of this agreement.
If you do not agree to all the terms and conditions of this website maintenance agreement, then you should not access the Website or use any services.
The materials contained in this web site are protected by applicable copyright and trademark law.

Description of Service

WordPromise services, including all media, document, updates, and support services associated with the Site and the WordPromise services (all collectively, the “Service”). You also understand and agree that the Service may include marketing material and that these marketing materials are necessary for WordPromise to provide the Service. You also understand and agree that the Service may include certain communications from WordPromise, such as service announcements, administrative messages & notifications, e-newsletter(s) and that these communications are considered part of your subscription plan. Unless explicitly stated otherwise, any new features that augment or enhance the current Service, including the release of new WordPromise properties, shall be subject to the TOS. You understand and agree that the Service is provided “AS-IS” and that WordPromise assumes no responsibility for the timeliness, deletion, mis-delivery or failure to store any user communications or personalization settings. In addition, you must provide and are responsible for all hardware & software necessary to access the Service.

Eligibility

To use our services, you must:

be at least eighteen (18) years old.
complete the registration process;
agree to these Terms and
provide true, complete, and up to date contact information;
WordPromise reserve a right to cancel the services off for any website having content deemed offensive according to community standards and/or applicable law. Website having content directly/indirectly related to nudity, pornographic or adult material, sexually explicit images or descriptions involving sexual behaviour, is strictly prohibited and will be discontinued from WordPromise without any further notice.

By using our services, you represent and warrant that you meet all the requirements listed above and that you will not use our services in a way that violates any laws or regulations. (Representing and warranting is like making a legally enforceable promise). WordPromise has the right to suspend or terminate your account and refuse any and all current or future use of the Service (or any portion thereof).

User account, password and security

You will receive a user account id and password upon completing the Service’s registration process. You are responsible for maintaining the confidentiality of the password and account and are fully responsible for all activities that occur under your password or account. You agree to (a) immediately notify WordPromise of any unauthorized use of your password or account or any other breach of security, and (b) ensure that you exit from your account at the end of each session. You are responsible for the software, hardware, and Internet service needed to access and use the Services. If you access and use the Services on your smartphone, tablet, or other mobile devices (“Mobile Device”), you are solely responsible for all data and additional fees related to using the Services through your Mobile Device. WordPromise cannot and will not be liable for any loss or damage arising from your failure to comply with this TOS.

Payment and renewal

General Terms

By signing up at WordPromise, you agree to pay WordPromise the one-time and/or monthly, quarterly, half yearly or annual subscription fees indicated. Subscription payments will be charged on advance basis on the day you complete the website onboarding process and will cover the use of that service for a monthly, quarterly, half yearly or annual subscription period as indicated. Payments are not refundable.

Automatic Renewal

Unless you notify WordPromise before the end of the applicable subscription period that you want to cancel a subscription, your subscription will automatically renew and you authorize us to collect the then-applicable annual or monthly subscription fee for such subscription (as well as any taxes) using any payment mechanism we have on record for you. Subscriptions can be cancelled at any time by reaching out to our support team or by logging into the WordPromise system dashboard.

Services

Availability

WordPromise does not guarantee the availability of the Service, and you may access the Service if and when it is available. The Service may occasionally be down for service, upgrades, maintenance, or other reasons. To the maximum extent authorized under applicable law, the Company reserves the right to change, remove, delete, restrict, block access to, or stop providing any or all of the Service at any time and without notice.

Fees; Payment

WordPromise reserves the right to change the payment terms and fees upon thirty (30) days prior written notice to you. Services can be cancelled by you at any time by clicking the link at WordPromise system dashboard, or submitting written notice to WordPromise.

Support

All subscriptions include access to support via the WordPromise system dashboard. “Support” means the ability to make requests for technical support assistance via the ticketing system at any time (with reasonable efforts by WordPromise to respond within 24-48 business hours). All support will be provided in accordance with WordPromise standard services practices, procedures and policies as outlined on https://www.wordpromise.com/

License to user

Permission is granted to temporarily view the materials (information or software) on WordPromise web site for personal, non-commercial transitory viewing only.

This is the grant of a license, not a transfer of title, and under this license you may not:

modify or copy the materials;
use the materials for any commercial purpose, or for any public display (commercial or non-commercial);
attempt to decompile or reverse engineer any software contained on WordPromise web site;
remove any copyright or other proprietary notations from the materials; or
transfer the materials to another person or “mirror” the materials on any other server.

This license shall automatically terminate if you violate any of these restrictions and may be terminated by WordPromise at any time. Upon terminating your viewing of these materials or upon the termination of this license, you must destroy any downloaded materials in your possession whether in electronic or printed format.

WordPromise makes no warranties, expressed or implied, and hereby disclaims and negates all other warranties, including without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose, or non-infringement of intellectual property or other violation of rights. Further, WordPromise does not warrant or make any representations concerning the accuracy, likely results, or reliability of the use of the materials on its Internet web site or otherwise relating to such materials or on any sites linked to this site.

Revisions and errata

The materials appearing on WordPromise web site could include technical, typographical, or photographic errors. WordPromise does not warrant that any of the materials on its web site are accurate, complete, or current. Limitations

All logos, product, and service names related to these TOS are trademarks of WordPromise (the “WordPromise Marks”). You agree not to display or use in any manner the WordPromise Marks without prior written permission.

WordPromise may revise these terms of use for its web site at any time without notice. By using this website, you are agreeing to be bound by the then current version of these Terms and Conditions of Use.

Applicable law

Any claim relating to WordPromise web site shall be governed by the laws of the Capital of India i.e., Delhi without regard to its conflict of law provisions.
